1. About These Terms

These Terms and Conditions ("Terms") govern your use of the website at bartekdgreat.com (the "Website") and any coaching services provided by BartekDGreat Ltd ("we", "us", "our"). By using the Website or purchasing a coaching programme, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you should not use the Website or purchase a coaching programme.

3. The Service

BartekDGreat Ltd provides a private 1:1 coaching programme focused on real-world social confidence, presence, and personal development for adult men. The programme is delivered over a period of twelve weeks and includes:

• Weekly private coaching sessions delivered via video call

• Direct messaging support between sessions

• In-field coaching in London where applicable

• Access to proprietary frameworks, exercises, and methodologies developed by BartekDGreat Ltd

The programme is offered on an application-only basis. Acceptance is at our sole discretion following a consultation call. We reserve the right to decline any application without providing a reason.

4. Eligibility

To enter into a coaching agreement with us, you must:

• Be at least 18 years old

• Have the legal capacity to enter into a binding contract

• Provide accurate and truthful information about yourself during the application process

• Agree to these Terms, our Privacy Policy, and our Refund Policy

The coaching service is intended for personal development purposes only. It is not therapy, medical treatment, or psychological intervention. If you are experiencing mental health difficulties, we strongly recommend you seek support from a qualified mental health professional.

5. Fees and Payment

The programme fee is £3,500 GBP, payable as a single payment or as three monthly instalments of £1,250 GBP. All payments are processed via Stripe, our payment partner. BartekDGreat Ltd does not store full payment card details.

By accepting your place on the programme, you authorise BartekDGreat Ltd (via Stripe) to collect the agreed amount(s) on the scheduled date(s).

Fees are quoted in GBP. Where a client pays from outside the United Kingdom, currency conversion is handled by Stripe at checkout and any associated fees are the client's responsibility.

6. Refunds and Cancellations

Refunds, cancellations, and the statutory Cooling-Off Period are governed by our separate Refund Policy, available at bartekdgreat.com/refund-policy. The Refund Policy forms part of these Terms and you should read it carefully before purchasing.

7. Client Commitments

By accepting a place on the programme, you commit to:

• Attending scheduled coaching sessions on time and prepared

• Completing the field exercises and assignments set between sessions

• Engaging honestly and openly during sessions

• Communicating proactively about scheduling, progress, and any difficulties

• Treating your coach with respect and professionalism

• Maintaining the confidentiality of proprietary frameworks and methodologies shared during the programme

We reserve the right to terminate the coaching agreement, without refund, in the event of a material breach of these commitments. Termination provisions are detailed in our Refund Policy.

8. Rescheduling

Coaching sessions may be rescheduled by either party with a minimum of 24 hours' notice. Sessions cancelled with less than 24 hours' notice will be considered delivered and will not be rescheduled, except at our discretion.

In exceptional circumstances (serious illness, bereavement, or other major life events) we may, at our sole discretion, agree to pause the programme. Pause requests should be sent to bartek@bartekdgreat.com.

9. Intellectual Property

All content, frameworks, methodologies, exercises, written materials, video content, and proprietary approaches developed by BartekDGreat Ltd remain the exclusive intellectual property of BartekDGreat Ltd.

By purchasing the programme, you are granted a personal, non-transferable, non-exclusive licence to use these materials for your own development. You may not:

• Reproduce, distribute, or share the materials with any third party

• Use the materials to deliver coaching, training, or consulting services to others

• Publish or republish the materials in any form

• Reverse-engineer the methodology to create competing services

• Record coaching sessions without our prior written consent

Breach of this clause constitutes a material breach of these Terms and may result in legal action.

10. Confidentiality

Both parties commit to maintaining the confidentiality of all information shared during the coaching relationship.

We will not share personal details, session content, or any information disclosed during coaching with any third party, except where required by law or with your express written consent.

You agree to maintain the confidentiality of any proprietary materials, methodologies, or business information shared with you as part of the programme.

11. Testimonials and Marketing

Where you provide a written testimonial about your experience, you grant BartekDGreat Ltd a non-exclusive, royalty-free licence to use that testimonial in marketing materials, including (but not limited to) the Website, social media, advertising, and printed materials. Testimonials may be edited for length and clarity but will not be edited in any way that materially changes their meaning.

We will not use your full name, photograph, or identifying details in marketing without your express written consent.

You may withdraw consent for the use of your testimonial at any time by writing to bartek@bartekdgreat.com. We will remove the testimonial from active marketing within a reasonable period.

12. No Guarantees of Outcome

Coaching is a collaborative process. Outcomes depend significantly on your engagement, effort, and individual circumstances. While we will provide our best professional effort and the methodologies we know to be effective, we make no guarantees about specific outcomes, including (but not limited to):

• Romantic or sexual outcomes with any individual

• Relationship status changes

• Specific levels of confidence, social skill, or personal change

• Any other personal or life outcomes

You acknowledge that you are responsible for the actions you take based on the coaching provided.

13. Limitation of Liability

To the maximum extent permitted by law, BartekDGreat Ltd's total liability arising out of or in connection with these Terms, the coaching service, or your use of the Website is limited to the amount you have paid to us under the relevant coaching agreement.

We are not liable for:

• Indirect, consequential, or special losses

• Loss of profit, revenue, or business opportunity

• Loss arising from decisions you make as a result of the coaching

• Loss arising from the actions of third parties (including other men or women you may interact with as a result of the coaching)

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under English law.

14. Use of the Website

You agree to use the Website for lawful purposes only. You must not:

• Attempt to gain unauthorised access to the Website or any associated systems

• Use the Website to transmit malware, viruses, or harmful code

• Scrape, copy, or republish content from the Website without our consent

• Use the Website to harass, defame, or harm any other person

• Impersonate any other person on the Website or in communications with us

We reserve the right to restrict or block access to the Website at our discretion.

15. Privacy

Our use of your personal data is governed by our Privacy Policy, available at bartekdgreat.com/privacy. The Privacy Policy forms part of these Terms and explains how we collect, use, store, and protect your personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

16. Third-Party Services

The Website and our coaching programme rely on third-party services including (but not limited to):

• Stripe (payment processing)

• Calendly (scheduling)

• Google Workspace (email and calendar)

• Framer (website hosting)

• ManyChat (Instagram automation)

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

17. Changes to These Terms

We may update these Terms from time to time. The version that applies to your coaching agreement is the version in effect at the time you purchased the programme.

We will notify existing clients of material changes by email. Continued use of the Website after changes to these Terms constitutes acceptance of the updated Terms.

18. Termination

Either party may terminate the coaching agreement in the circumstances set out in our Refund Policy.

These Terms otherwise remain in effect for as long as you use the Website or are engaged with BartekDGreat Ltd as a client.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

20. No Waiver

Failure by us to enforce any right under these Terms does not constitute a waiver of that right.

21. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and BartekDGreat Ltd regarding the coaching service and supersede any prior agreements or understandings.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
